How to Dispute an Overpayment From Social Security Disability
The Social Security Administration (SSA) occasionally makes mistakes in calculating back payments and monthly payment amounts for Social Security disability. If SSA determines that it overpaid you, it will typically deduct 10-to-15 percent of your SSDI check each month until the overpayment is repaid. If you disagree with the overpayment or feel that repaying the overpayment will cause undue financial stress, you can dispute the overpayment.Instructions

Obtain the necessary appeal forms from SSA.gov or your local Social Security office. If you are disputing the overpayment amount, you will need to file the form "SSA-561-U2". If you are requesting that the overpayment be waived or that the monthly payment be reduced due to financial hardship, you will need to file the form SSA-632-BK.

Gather the necessary documentation to support your case. including bank records, rental leases, utility bills, documentation of credit card debt and other loan debt, out-of-pocket medical costs and other monthly expenses. Supporting documentation for disputing the amount of the repayment is documentation of outside income--if the reason for the overpayment was outside income--and other documentation that shows that the overpayment amount is wrong.

Complete the necessary forms. which will require writing your full name, Social Security number, source of Social Security payments, e.g., your own disability or widower's benefits, questions regarding your finances, dependents, resources and a statement of the reason for requesting an appeal, dispute or waiver.

Submit the forms and supporting documentation to your local SSA office in person or by mail. If you do not know where your local Social Security office is located, call (800)-772-1213.
