The FMLA & Chronic Conditions

The Family Medical Leave Act (FMLA) states that an individual can take up to 12 weeks a year to care for his own health or someone in his immediate family. The leave is unpaid but you can return to work knowing your job will still be there for you.
  1. Restrictions

    • The employee must work for a company for one year or at least 1,250 hours during the year to be eligible for leave under the FMLA.

    Chronic Illness

    • The individual does not have to take the 12 weeks at one time due to a surgery, illness or injury. Time off during a pregnancy or due to chronic conditions such as multiple sclerosis or asthma problems can be cumulative and taken when necessary.

    Time Off

    • If the person has time off due to physical therapy appointments, doctor visits or other routine health care for the chronic illness, she must schedule it beforehand with her employer if possible.
