Can asbestos containing mastic on concrete be used as clean fill?

Asbestos containing material (ACM) is regulated as a hazardous waste, so any attempt to dispose of it as clean fill is illegal. Any soil contaminated with asbestos fibers is also regulated as a hazardous waste, so it cannot be used as clean fill either.
