How to Get Medical Records in New York

Medical records, which may also be called medical charts or health records, are systematic documentation of a patient's history, which includes treatments, diagnosis and care. The sensitive information found within these records has caused medical facilities to closely protect them. The New York Department of Health states all patients and other qualified persons may obtain copies of their medical records at any time.

      Write an official request for a copy of your medical records. This may be done by hand, or typed on a computer word processing program. Within the request, state your full name, and the name found on the medical records. State you are qualified to request a copy of your medical records, and why you are requesting a copy of your records. Sign and date the written request, and have the request officially notarized by a New York State Notary. For example,

      "Hello, my name is John Carl Smith and I am requesting a copy of my certified medical records, under the name 'John Carl Smith.' Under New York State law outlined by the New York Department of Health, I am qualified to make this request. My medical records are held by the "General Hospital" and the purpose of this request is to review my medical history. Thank you very much for your time."

      If the medical records are to be sent to a third party, you must include the name and address of the third party at the end of the request letter.

      Mail the notarized medical records request to the health care provider. Upon receiving this request, the health care provider has at least 14 days to comply. The New York Department of Health states there is no legal time limit for a health care provider to respond to this request; however, Health Department suggests waiting at least 14 days before pursuing further action.

      Pay any fees associated with retrieving a copy of your medical records. The New York Health Department states a physician or medical provider may not charge more than $0.75 per page for paper copies; however, if you are unable to pay the fees the health care provider or physician is forbidden to deny your request based on your inability to pay the fees.

      Contact the New York State Health Department at 800-663-6114 if the medical facility or provider does not respond to your request, or denies your request. New York State law reports that if a medical professional or facility denies a medical record request from a qualified individual, it is considered medical misconduct. This disobedience to state law may result in disciplinary action against the medical provider or facility.
