If I'm Fired, Can I Get Cobra?

Under many circumstances, if you lose your job, you may qualify for health insurance under COBRA, the Consolidated Omnibus Budget Reconciliation Act. COBRA allows you to keep the health insurance you held at your job for a temporary period of time. You must be enrolled in a health plan to qualify for COBRA coverage.
  1. Qualify for COBRA

    • An employee can qualify for COBRA if terminated. However, if the termination is because of gross misconduct, the employee will not be eligible for COBRA benefits.

    • Not all health insurance plans qualify for COBRA. Health plans for employers who have fewer than 20 employees are not eligible for COBRA.

    Who is Eligible?

    • If your spouse and children were included on your health plan and you qualify for COBRA, your spouse and children are also eligible for coverage.

    Time Frame to Apply for COBRA

    • After you are terminated from your position, a notice for COBRA election is sent to the former employee. Once the notice is received, you have 60 days to make your elections for COBRA.

    How Long is COBRA in Effect?

    • COBRA insurance provides benefits for a period of 18 months. If you are disabled, you may apply for an extension of this coverage with the Social Security Administration.
