How to Consent to Medical Care in Pennsylvania

Pennsylvania law recognizes "express" and "implied" consent in health care. Express consent is given in writing or verbally. Express consent documents should include the name of the health care professional who discussed the proposed treatment with the patient, as well as the name of the health care provider who is to perform the procedure. Implied consent is consent that is assumed, as during a surgery or procedure where a surgeon is required to perform an unforeseen procedure during the course of a surgery. All treatment options and potential problems should be explained by medical staff before any treatment or procedures are performed.

      Visit your local doctor's office or health care facility. Request that a qualified health care professional, such as a nurse or physician, thoroughly explain the planned course of treatment and/or procedure(s).

      Read the consent agreement thoroughly. Ask questions regarding any portions of the agreement that are not clear. If you are having a procedure performed, ask the physician about potential scenarios that may arise in which implied consent would come into play. Detailed information regarding both express and implied consent should be outlined in the consent documents.

      Sign the consent documents. Ask for a photocopy of the documents for your records.
