What happens at medeation if you cant agree?
If the parties are unable to reach an agreement through mediation, there are a few possible outcomes:
The mediation may be terminated unsuccessfully; the participants are free to take further action outside of mediation, such as pursuing litigation.
The conflict may escalate; frustration might result from the process as parties feel they did not gain the results necessary or that too much was asked for compromise.
Parties can decide to enter into arbitration;; Arbitration presents more of a court structure where parties meet before third party(ies) that ultimately make final and/or binding decisions or recommendations if necessary to conclude resolution.
Parties can pursue legal intervention and proceed accordingly, which entails litigation for resolutions.
