Nursing Home Patient Rights in Florida

A nursing home patient has rights when it comes to the care and treatment he receives in a Florida skilled nursing facility. The state has clearly defined rights of nursing home patients.
  1. A Right to Privacy

    • According to the Florida statutes on nursing home patient rights, a nursing home patient has a right to some degree of privacy unless a medical condition prevents this. Medical staff is expected to knock before entering a patient's room. Medical information is expected to be kept confidential. Patients have the right to make and receive unmonitored phone calls, send and receive mail without letters being opened by staff, and speak with visitors in confidence.

    Right to Make Medical Decisions

    • A nursing home patient has the right to make her own medical decisions provided she is mentally competent and able to make informed consent. A patient should be allowed to choose her own doctor. She should be completely informed about her medical condition and all available treatment options.

    Religious Freedom

    • A patient in a nursing home has the right to practice whatever religion he desires. Accommodations are to be made for religious observation.

    Right to Humane Treatment

    • A nursing home patient has a right to be treated with respect. She is not to be abused, neglected or mistreated in any way. A patient has the right to engage in appropriate social activities and to have friends and family members visit. If a patient feels she is not being treated properly, she has the right to express this without fear of punishment or further maltreatment.

    Financial Rights

    • A nursing home resident in Florida has the right to manage his own finances or appoint someone else to do so. Funds in patient accounts are not to be used for any purpose than that directed by the resident or financial adviser.
