How to Report Doctors to NYSDOH

When a physician or other health care professional does not perform his duty to the required medical-legal standard of care, resulting in harm, it is called medical malpractice. If you or someone you know in New York has been the victim of negligent treatment by a physician, you will want to make sure the incident is reported to the New York State Department of Health, to make sure the it doesn't happen to someone else and that the physician is investigated and disciplined.

      Visit the official website of the New York State Department of Health at Health.State.NY.us and download and print out a complaint form.

      Read and fill out the complaint form completely using an ink pen. You can also type the report, if you want. Describe the incident with the physician as completely as you can, and include the names of any witnesses; attach additional pages if you need to.

      Make copies of any papers; such as physician correspondence or bills. Do not send original documents to the NYSDOH.

      Mail the complaint form and copies of supporting papers to:

      Contact the Office of Professional Medical Conduct at (518) 402-0836 or 1-800-663-6114, one week after mailing the papers to follow up on your complaint.
