Nebraska Marijuana Laws

Each state has different laws regarding the use, possession and sale of marijuana. While some states have made it legal to use marijuana for medicinal purpose, Nebraska is not one of them. Nebraska has specific laws and consequences in place if anyone gets caught possessing, growing or selling marijuana.
  1. Possession

    • The first offense for possessing one ounce or less of marijuana entails a $100 fine. As the possessor continues to incur offenses, the fine can range from $200 to $10,000 and require up to five years in jail. This also may include a drug and alcohol evaluation with recommended drug treatment classes.

    Sale

    • Selling marijuana in Nebraska is a felony. It can result in one to 20 years in jail and include a $20,000 to $50,000 fine. If sold to a minor or near a school, the consequences may be more severe, such as up to 50 years in jail.

    Paraphernalia

    • Possessing any marijuana paraphernalia can result in a fine. This means any pipes or other paraphernalia found in a house or car. This fine can be anywhere from $100 to $500. A minor who is found with paraphernalia may have to complete a drug and alcohol evaluation and get recommended treatment.

    Growing

    • Any marijuana found on personal land has similar consequences to the sale of marijuana. This is considered a felony and the guilty party will be fined up to $50,000. The consequence of growing marijuana in Nebraska is jail time from one to 50 years.
